Vaybak! Voluntary Content Contribution and Publication Permission Agreement
Version: 2026-10-24
This agreement is between the adult who voluntarily provides videos and similar content (the "Creator") and the party that operates the Vaybak! children's discovery platform (the mobile app, vaybak.app and related services; the "Platform"), referred to as the "Operator".
Operator: ARTE BİLGİ TEKNOLOJİLERİ YÖNETİM DANIŞMANLIK TİCARET LİMİTED ŞİRKETİ. Address: Konaklar Mah. Ladin Sok. Yeni Levent Sitesi 12/B Blok No: 11/1, 34330 Beşiktaş / Istanbul. MERSİS no: 0085039242200016. Tax office and number: Beşiktaş, 0850392422. Contact: [email protected]
1. Purpose
1.1. The Platform offers age-appropriate, human-reviewed content to support the development, curiosity, learning and enjoyment of children aged 2 and over.
1.2. To contribute to this purpose, the Creator offers to the Platform videos that the Creator has made or has the right to use, and agrees that these videos may be added to the Platform.
2. Voluntary and unpaid contribution
2.1. The contribution is entirely voluntary and without compensation. The Creator does not ask for a fee, royalty, commission, revenue share or any other consideration. This agreement does not create an employment, service or partnership relationship.
2.2. The permission given applies whether the Platform is offered free of charge or for a fee (for example by subscription). The Platform's children's feed contains no advertising; the Creator's content is not used for advertising or product promotion.
2.3. The Operator is not obliged to publish any content that is offered. The decision to publish, after human review, belongs solely to the Operator.
3. Ownership of rights
3.1. Ownership of the rights in the content remains with the Creator (or with the original rights holders). This agreement does not transfer any rights; it only grants the permission to use set out below.
3.2. The Creator remains free to use, publish and license to others, elsewhere, the content offered to the Platform.
4. Permission granted
4.1. For each item of content that the Creator offers to the Platform and marks as covered by this agreement, the Creator grants the Operator a free of charge, perpetual, worldwide, non-exclusive permission of use. "Perpetual" means valid for the whole statutory term of protection of the content.
4.2. The economic rights under Law No. 5846 on Intellectual and Artistic Works (FSEK) are listed separately as follows:
-
a) Right of reproduction (çoğaltma hakkı): to store and back up the content on servers, to convert it to different resolutions and formats, and to cache it temporarily on children's devices for offline viewing.
-
b) Right of adaptation (işleme hakkı): to adapt the content for the Platform. This includes:
- vertical (9:16) or horizontal layout, cropping and shortening,
- Turkish subtitles, voice-over or translation,
- preparing a cover image and a title,
- adding age and topic labels,
- adding educational questions or links to games related to the content.
Adaptation is made in a way that does not distort the essence of the content, does not belittle the Creator, and respects moral rights.
-
c) Right of distribution (yayma hakkı): to make digital copies of the content available to Platform users through the Platform.
-
d) Right of performance/display (temsil hakkı): to show the content in the Platform's apps and web pages.
-
e) Right of communication to the public (umuma iletim hakkı): to make the content accessible through the internet, mobile networks, streaming and content delivery networks (CDNs), at a place and time chosen by the user.
4.3. Promotion: The Operator may use short excerpts and still images of the content to promote the Platform itself (app store page, vaybak.app). This use is not made to advertise any other product.
4.4. Service providers: The Operator may give access to technical service providers that are necessary to run the Platform (hosting, storage, video processing, content delivery), to the extent that they act on the Operator's behalf. The content is not sold to third parties and is not licensed for any other purpose.
4.5. Transfer: If the Platform is transferred to another operator, this permission passes to the new operator on condition that it continues the Platform for the same purpose.
5. The Creator's declarations
For every item of content offered to the Platform, the Creator declares the following:
5.1. The Creator is at least 18 years old and has the capacity to accept this agreement on their own behalf.
5.2. The Creator is the rights holder of the content, or holds in writing all the permissions needed to grant the permission in this agreement.
5.3. The Creator holds the right to use, within the scope of this permission, all music, sound, images, typefaces, trademarks and other parts of the content.
5.4. The Creator has obtained written permission from everyone who appears or is heard in the content. For every child who appears, the Creator has obtained the written permission of the child's parent or guardian, and can present these permissions to the Operator on request.
5.5. The content does not contain information that would reveal the identity of children (full name, school, home address, location, etc.).
5.6. The content does not contain:
- hidden advertising, sponsorship or product placement,
- external links or redirects,
- violence, frightening scenes, disparagement or discrimination,
- dangerous behaviour that children could imitate.
The content complies with the Platform's age and safety rules.
5.7. If any of the Creator's declarations is untrue and a rights holder therefore makes a claim against the Operator, the Creator agrees to cover the reasonable losses arising from it.
6. Review, editing and removal
6.1. Every item of content goes through a technical check and human review before publication. The Operator may accept the content, ask for corrections, or reject it with reasons.
6.2. The Operator may remove content from publication immediately if it suspects a rights infringement, a child-safety problem or a legal requirement.
6.3. Removal request: The Creator may ask for published content to be removed from the Platform by writing to [email protected]. The Operator will remove the content from new views within 30 days at the latest. Statutory retention obligations, temporary copies already downloaded to users' devices before removal, and short-term technical backups may not be affected by this request.
7. Display of name
7.1. The display name chosen by the Creator may be shown in the information section of the content and in the parents' area. No external link or social media account is shown in the children's feed.
7.2. The Creator may ask for their name not to be shown.
8. Personal data
8.1. The Creator's name, e-mail address, agreement acceptance records and upload records are processed for account management, content review, keeping rights records and legal obligations.
8.2. This data is never combined with children's profiles in any way. It is not used for advertising or marketing.
8.3. Details are in the separate privacy notice on personal data. The Creator may exercise their rights regarding their data through the application routes described in that notice.
9. Acceptance, records and changes
9.1. The Creator accepts this agreement electronically on the Platform. The acceptance record includes the agreement version, a digest (hash) of the text and the time of acceptance.
9.2. With every content upload, the Creator separately confirms the declarations in clause 5 for that content. The permission applies to that content together with this confirmation.
9.3. If the Operator changes the agreement, the new version is presented to the Creator for acceptance before any new uploads. Content submitted earlier remains bound to the version under which it was accepted.
10. Closing the account
10.1. The Creator may close their account at any time. The Operator may also suspend or close the account in case of breach of this agreement.
10.2. Closing the account does not end the permission given for content that has already been published. For such content the Creator may use the removal request in clause 6.3.
11. Governing law
This agreement is governed by the law of the Republic of Türkiye. The Istanbul courts and enforcement offices have jurisdiction over disputes.
